The class action lawsuit, filed in federal court on May 22, claims the company added “tariff surcharges” to customer orders during Donald Trump’s controversial import tariff policies. Now that the Supreme Court has struck down those tariffs, plaintiffs argue that companies like Savage X Fenty could receive government refunds while customers are left paying the extra costs.

The legal action marks the latest challenge for major retailers navigating the aftermath of the court’s decision.

Customers Seek Refunds for Tariff Charges

The lawsuit was brought by customer Ajani Hoffert, who alleges that Savage X Fenty added a $44.04 “TARIFFS” surcharge to an online purchase made in April 2026.

According to the complaint, the company informed consumers that the additional fees were tied to rising import costs caused by tariffs. However, the lawsuit argues that if the federal government refunds those tariff payments to businesses, customers who covered the added expenses should also receive compensation.

Lawyers representing Ajani Hoffert claim the case could potentially involve “millions of consumers” who paid similar surcharges while shopping with the brand.

The filing argues that Savage X Fenty could receive a “double recovery” by first collecting tariff-related charges from customers and later reclaiming those same costs from the government.

Supreme Court Tariff Ruling Sparks Corporate Fallout

Earlier this year, the U.S. Supreme Court ruled that Trump exceeded his legal authority when imposing broad import tariffs under emergency powers laws.

The decision invalidated tariffs placed on goods imported from numerous U.S. trade partners and is expected to trigger billions of dollars in refunds to businesses that paid the duties.

Since the ruling, several companies, including Amazon, Nike, Toyota, Costco, and FedEx, have reportedly faced similar lawsuits from consumers demanding reimbursement for tariff-related price increases or fees.
