Stunt performer Devyn LaBella has filed a bombshell lawsuit against Kevin Costner, his production company Horizon Series Inc., and Territory Pictures, alleging she was subjected to an unscripted and unapproved rape scene during filming of Horizon: An American Saga — and without an intimacy coordinator present.

The lawsuit, filed in Los Angeles County Superior Court, paints a harrowing picture of a “violent, unscheduled” scene that left Devyn LaBella with lasting trauma and, she claims, derailed her rising career. According to court documents, the incident occurred a day after a planned and choreographed rape scene — one where standard protocol, including the presence of an intimacy coordinator, was observed.

The next day, Horizon stunt performer Devyn LaBella alleges, she was unexpectedly required to perform a second, unplanned rape scene involving a different actor, Roger Ivens, with no warning or consent process. The suit claims that LaBella was not informed that actress Ella Hunt had refused to perform the scene and walked off set, and instead, LaBella was abruptly placed in the role.

“There was no escaping the situation,” the lawsuit states. “All Ms. LaBella could do was wait for the nightmare to end.”

LaBella, who has worked on high-profile productions including Barbie and Yellowjackets, described being pinned down during filming, with the male actor forcefully lifting her skirt while she remained unclear when the scene began or ended. The filing adds that Ivens rested his hand near her genitals between takes — all while no intimacy coordinator was present, a direct violation of current industry standards.



Kevin Costner Denies Allegations, Calls Lawsuit a “Shakedown”

Kevin Costner, through his attorney Martin Singer, has forcefully denied all allegations, calling the lawsuit “meritless” and accusing LaBella of being a “serial accuser” in Hollywood. Singer claims that LaBella had approved the scene during rehearsal and even sent a positive thank-you message to the stunt coordinator afterwards.

“Our client Kevin Costner always wants to ensure a safe and respectful work environment,” Martin Singer said in a statement. “These claims are completely contradicted by Ms. LaBella’s own actions and words.”

Devyn LaBella disputes this, asserting she was never fully briefed about the changes to the scene and was emotionally devastated by what transpired. The complaint lists sexual harassment, discrimination, hostile work environment, and retaliation among its causes of action. She also claims she has not been hired by the production team since.

The lawsuit further requests that Kevin Costner’s team undergo anti-sexual harassment and anti-sexual violence training and formally apologize. It seeks unspecified compensatory and punitive damages.

As Horizon: An American Saga struggles commercially — its sequel already pulled from theatrical release — this legal battle could further overshadow Kevin Costner’s ambitious Western franchise. The outcome may also reverberate through the stunt community and Hollywood at large, where conversations about consent, safety, and accountability remain front and center.
