‘Violates law of equality’: SC quashes Maratha quota in govt jobs and admissions

The Supreme Court has struck down the Maharashtra government’s move to grant reservation to Maratha community in admissions and government job, ruling the state could not exceed 50% ceiling on quota. A five-judge constitution bench headed by Justice Ashok Bhushan announced the verdict saying, there was no valid ground to breach 50% reservation while granting Maratha reservation, news agency ANI reported.



“The 2018 Maharashtra state law violates right to equality. We won’t re-examine the 1992 verdict which capped reservation at 50%,” the top court said while pronouncing the judgement. The SC also said the state failed to show any extraordinary reason why Marathas should be considered as socially and economically backward class.

The court was hearing a batch of petitions that challenged the constitutional validity of the Maharashtra law that grants reservation to the Maratha community in education and jobs.
,saying it would breach the ceiling of 50% quota limit imposed by the Supreme Court itself in a landmark verdict in 1992.

The Centre had argued in the top court that Maharashtra has the legislative competence for granting reservation to Marathas and its decision is Constitutional as the 102nd amendment does not denude a state of the power to declare its list of Socially and Educationally Backward Classes (SEBC).

Earlier, the Bombay high court, while upholding the law in June 2019, had held that 16 per cent reservation was not justifiable and the quota should not exceed 12 per cent in employment and 13 per cent in admissions.

The apex court had on September 9 last year stayed the implementation of legislation and referred to a larger bench the batch of pleas challenging the validity of law, but made it clear that status of those who have availed of the benefits would not be disturbed.
