Harvey Weinstein Rape Retrial Ends in Mistrial After Jury Deadlock
A New York judge has officially declared a mistrial in the rape retrial of former Hollywood producer Harvey Weinstein after jurors failed to reach a unanimous decision following days of deliberation.
The closely watched case centered on allegations brought by aspiring actress and hairstylist Jessica Mann, who accused Weinstein of raping her in a Manhattan hotel room in 2013. Harvey Weinstein has consistently denied assault allegations and maintained that the encounter was consensual.
The mistrial marks yet another dramatic chapter in the long-running legal battles surrounding the disgraced film mogul and the global #MeToo movement.
Judge Declares Jury “Hopelessly Deadlocked”
The majority-male jury deliberated for three days before informing Judge Curtis Farber that they could not reach a unanimous verdict. Jurors initially sent a note stating they were unable to agree, prompting the judge to instruct them to continue discussions.
However, after additional deliberations failed to break the impasse, Farber declared the jury “hopelessly deadlocked” and officially ruled a mistrial.
According to reports, Harvey Weinstein remained expressionless as court officers escorted him from the courtroom in a wheelchair after the decision was announced.
One juror later told reporters that the panel was deeply divided, with nine jurors reportedly favoring acquittal and three supporting a conviction.
Case Has Been Retried Multiple Times
This was the third time a New York jury examined the allegations involving Jessica Mann. Harvey Weinstein was originally convicted in 2020, but an appeals court overturned the verdict in 2024, ruling that testimony from additional accusers unfairly influenced the original trial.
A retrial held last year also failed to produce a final verdict after jurors became deadlocked on the rape charge.
The latest mistrial now leaves prosecutors with another difficult decision about whether to pursue a fourth trial against the former producer.
A court hearing has reportedly been scheduled for June 24 to determine the next steps in the case.
Jessica Mann Testified About “Complicated” Relationship
During the retrial, Jessica Mann testified over several days, describing what she called a complicated and emotionally difficult relationship with Weinstein.
Jessica Mann acknowledged that some encounters between them were consensual, but alleged that Harvey Weinstein raped her during a separate incident despite repeated refusals.
Weinstein’s defense team argued that Jessica Mann continued communicating with him afterward and presented messages they claimed showed warmth and affection following the alleged assault.
The defense maintained throughout the trial that the relationship was consensual and accused prosecutors of retrying the same allegations repeatedly despite divided juries.
Weinstein Remains Imprisoned
Although the mistrial leaves the New York rape charge unresolved, Weinstein remains behind bars due to other criminal convictions.
The former movie executive has also faced legal consequences in California and remains one of the most controversial figures connected to the #MeToo movement, which reshaped conversations around sexual misconduct in the entertainment industry and beyond.
Manhattan District Attorney Alvin Bragg said prosecutors are reviewing their options and consulting with Jessica Mann before deciding whether another retrial will move forward.
